കൊലെന്ചെരി ഓര്‍ത്തഡോക്‍സ്‌ പള്ളി കേസ് : ഇടക്കാല ഉത്തരവ് ഇല്ല


കൊലെന്ചെരി ഓര്‍ത്തഡോക്‍സ്‌ പള്ളി കേസ് : ഇടക്കാല ഉത്തരവ് ഇല്ല. തല്സ്ഥിതി തുടരണമെന്ന യാകൊബായ വാദം തള്ളി.  ഗവേര്‍മെന്റ്റ് നടത്തുന്ന മധ്യസ്ഥ ശ്രമങ്ങളോട് ഇരു വിഭാഗവും സഹകരിക്കണം: ഹൈക്കോടതി. കേസ് നവംബര്‍ 2- നു പരിഗണിക്കും.

ഇനി തീരുമാനം എടുക്കേണ്ടത്  ഗവേര്‍മെന്റ്റ്. ദിവസേന പ്രശ്നങ്ങളില്‍ കുടുങ്ങുന്ന ഉമ്മന്‍ ചാണ്ടിയും കൂട്ടരും ഇനി എന്ത് തീരുമാനം എടുക്കും?

Justice Thottathil B Radhakrishnan Specifically ordered that 'the Government must take efforts to settle the grievances of both factions peacefully and amicably. Court Orders and Decrees never leads to an end to the disputes of two factions'.
So ruling Government must act as per their written statement to malankara sabha and prove their responsibility as an executive machinery of the State.

Dear All
This Court Ruling has no effects at all!There is nothing new in the stay appeal as they are going to consider the case on November 2!The Kerala Govt will say there is still time until November 2nd, for the court to consider the appeal! by this time H.B.Thomas group will make new move or efforts to enter into Kolenchery Church by any ways!

Govt. gave the written statement that they will execute court order. Today Hon. High court asked both the factions to discuss the matter and reach a settlement. Hon. court never ordered to execute District court order. If the judjement was like that, then the order should be "..The pray is rejected and can go on with district court order". Hon. court directed to reach a settlement and not for implementing 1934 constitution. So the govt. will keep their word.
They will go with discussions. I'm sure they will never implement 1934constitution without Hon. High court judgement.
So till the final verdict instead of keeping the church closed, its better to open the church and continue with the turns.

Today's Hon. High Court direction is to reach a settlement between the two factions. Hon. court didn't gave the direction to execute Hon. Dist. court order. The case is still on. So orthodox faction cant ask for execution right now. Govt. will surely execute Hon. High Court order as they said before.
Govt. will continue their efforts to reach a settlement. It doesnt mean that all of a sudden they will execute dist. court order.
Hon. High Court didnt gave an interim order. It doesnt mean that the case is dismissed. If it was like that then the judgement will be "The pray is rejected and govt. can execute Dist. court verdict".

Hon. High court didnt mention about execution of dist. court order.

So till the final verdict its better to open the church for two factions than keeping it closed.

Now no one can blame Sri. Ummen Chandy for not executing dist. court order. The govt. will execute the directions given by Hon. High Court and will go on with mediation talks.

Mediation talks cant favour only one faction.
Now orthodox faction need to change their decision as per court's direction.

Justice to the Righteous from the court. But Now the Government should say whether they are with Justice......... or only concerned on vote bank methodology...........?

First up all collect the Church members opinion and base on that Government should take a decision.

Mediation will never work as bothe parties are working in opposite direction. Orthodox party wants unity and Jacobite want division.

There is no history of any past similar curch disputes ending amicably by mediation.

Last time unity happened with patriarch faction after 1958 supreme court verdict.

Issues with Mar Thomas Athanasius of Mar Thoma Church resolved by the Seminary suit.

Dispute with the Mission Society came to an end by the “Cochin Award of 1840”.

This is our history. If any one thinks that mediation is the solution, they are living in fools paradise.

"Let the Majority Decide", WHAT???
Regarding the Kolenchery Church, I am amazed at the repeat statement by learned people 'let majority decide and go from there'. Sounds democratic and simple. Majority in Kashmir are Muslims and they want to join the country Pakistan. Punjab want to develop an independent Khalistan from India and seperate. Hindus are 80% of the Indian population. If they simply vote and say there should not be another religion. Can we digest that scenario. A parish church is a single entity in a wide spectrum 'the Church or sabha. As Kashmir is a state under the union India, they are bound by the constitution of India, an individual church is bound by the doctrine and theology of the union, the Sabha. If 51% of an established Orthodox Church decide to join the Pentecostal group, do they have any right on the mother church. No, on the other hand they are free to join any group anytime as the fundamental right of an Indian Citizen.

Mona Ronnie, How come orthodox church wanted seperation in malabar, where the churches are poor and unity only in churches which has a lot of property and institutions. Aa unity nammuku venda.

There are no need of mediation regarding Kolenchery Church!The case filed by Jacobites and the court verdict/ruling were not favouring them! So they should respect court verdict/decree as well as law and order! Majority issue or referendum do not arise here at all!H.B.ThomasI should stop his all protest immediately!

Mr.Dony Chennoth, ഹൈക്കോടതി എന്താണ് പറഞ്ഞത്. സര്‍ക്കാരിന്റെ മധ്യസ്തതയോട് സഹകരിക്കണം. അല്ലാതെ ഒരു ഓര്‍ഡര്‍ കൊടുത്തത് അല്ല. ഇത് ഒരു വിധിയും അല്ല.

MOSC are not protesting for disobey court orders or court decrees!Those protest against court orders or court decrees are not even democratic people or who stand foe justice!
